PLEASE READ THESE TERMS OF USE CAREFULLY. Your use of this Medtronic Discovery™ Link™ Website ("Site") is governed by the terms of your Medtronic CareLink Network Services Agreement (the "Agreement"). You should refer to the Agreement if you have any questions regarding Medtronic CareLink™ Network Services. The purpose of these Terms of Use are to highlight certain important conditions of your use of this Site and are not intended to alter or contradict the terms of the Agreement.

 

As you use this Site, you should keep in mind the following:

• Security. You are solely responsible for maintaining the security of any password and user ID assigned to or chosen by you for access to this Site.
• Patient Transmissions of Device Data. Medtronic does not have control over when a Medtronic CareLink™ monitor patient chooses to transmit device data. Clinicians should discuss this issue with their patients and review the Site for new transmissions.
• No Medical Advice. Clinicians are the sole providers of all medical and other health services to patients relating to the remote monitoring of Medtronic implanted cardiac devices for patients for whom Medtronic CareLink monitors have been prescribed. This includes, for example, scheduling of patient monitoring and office visits, patient diagnosis, treatment and referral to other health professionals and providers, contracting with third party payers, billing and collection, and compliance with all laws and regulations applicable thereto. Without limiting these statements, clinicians will be responsible for monitoring and reviewing any patient health care data or information on the Site, including any device data, contacting patients regarding any unsuccessful transmissions of device data, communicating the results of all remote monitoring to patients, as necessary, and arranging for any patient health care services, including any indicated by the remote monitoring. You should be aware that the Medtronic CareLink Network Services are not patient health care services, that Medtronic is not a provider or supplier of any patient health care services, that Medtronic has no responsibility for reviewing, monitoring or otherwise analyzing any device data or other patient health care data or information, billing, collecting any amounts that you or your clinic may charge patients for use of the monitor or any other services provided by you or your clinic, and that Medtronic will not be considered to be furnishing any patient health care services by virtue of its provisions of the Medtronic CareLink Network Services. You should also be aware that use of the Medtronic CareLink Network Services, including the monitor, are not the exclusive method of interrogating patients\' implanted cardiac devices, nor are they intended to be used as a life-sustaining or interventional tool during medical emergencies. The Medtronic CareLink™ Network Services do not in any way relieve doctors and/or other employees or agents from using their best medical judgment to determine a proper course of treatment for patients.
• Not a Medical Record. The device data and other patient health information which appears on your computer screen is not a legal medical record and should not be treated as such. Always print out a copy of such data and other information for your patient records. Although Medtronic will make reasonable efforts to ensure the integrity and accessibility of the data and clinician notes, if any, contained in the Medtronic CareLink™ Network, Medtronic does not guarantee that any data or clinician notes are accurate, medically sound or otherwise reliable as a basis for making clinical decisions.
• Feedback, Comments and Ideas. Your comments and ideas are very important to us. Please remember that your submissions are governed by the Agreement. In particular, you may want to review the section regarding Medtronic\'s use of your comments and ideas.
